TERMS OF USE

You are using the mobile application and/or website and/or web pages via your device (collectively, the "APP") of Mama K BEST Ltd. of Habrosh St., Israel, including its employees, agents, advisers, and any entity on its behalf (hereinafter, "MKB"). The purpose of this APP is to provide anyone with a single they want to match a platform to do so and to ensure all matchmakers a significant chance to find love for their singles. The APP provides a dating platform and also a platform for matchmakers to network through the APP. Matchmakers using the platform can be a mom, aunt, sister, friend or even a grandma (the "Service").
The use of this APP is subject to all terms and conditions and the Privacy Policy specified herein and in the Privacy Policy  which constitutes an integral part of these Terms of Use (hereinafter, the “Terms” or the “Terms of Use”). The Terms are intended to clarify the legal relationship between MKB and you, the user, any person operating  the APP and/or using the Service or anyone on your behalf (hereinafter "you" or "your"). You hereby acknowledge and consent to all the provisions specified under these Terms with respect to any action and/or activity you take part of or within the APP and/or the Service, including browsing and/or uploading details and/or communication with other users of the APP in any form and/or manner.
 

BINDING TERMS

By operating the APP, downloading any information from the APP, installing the APP or by using the Service, you acknowledge and confirm that You have read and understood the Terms and the Privacy Policy, which constitutes an integral part of these Terms, and you agree that these Terms are binding without any limitations and/or reservations, and You will abide by all laws and regulations that apply in respect of using the APP, and You hereby irrevocably confirm that these Terms form a legally binding and enforceable contract between You and MKB, and You consent and undertake to act or refrain from acting as specified in these Terms.

The section headings are provided solely for convenience and ease of use, and they shall not be ascribed any interpretive value whatsoever.
By using the App you consent to the terms and conditions of these Terms.
Persons under the age of 18 and/or persons suffering from any mental health disorders or mental condition that may affect their use of the Service and/or may be affected by their use of the Service are prohibited from using this APP.
Please note! The Service does not constitute and does not include psychological assessment/test and/or a substitute for psychological counselling and/or care. In any case that you suspect an issue, you must seek qualified assistance. 
 

THE SERVICE

The APP will support matchmakers in a new and relevant way. Support will be provided mainly through the APP’s the matchmaking platform and its community, and such support may include, instructions and chat, education, and etc. Unfortunately, MKB cannot guarantee that You will witness a match directly from the Service, and MKB does not guarantee that you will receive any match by operating and using the APP.
In order to use this APP, you must have a smartphone or an adequate device that can access the Internet and meets all Service requirements. 
Based on the information that you will provide us, MKB will be able to use it for the Service, and to help you to improve your matchmaking abilities. However, we are not responsible for the content you provide, including without limitation, with respect to all online platforms, categories, network, organization and information presented therein, messages and push notifications, and any other method of illustration included in the APP through messages and push notifications, and including any data, text, statistics, software, sounds, images, graphics, charts, videos, messages and/or any other information inside the APP (collectively, the “Content”).
At this time, the Service does not include any sort of payment, but it is possible that we will decide to change this instalment in the future or charge for using the Service and/or some part thereof in the future subject to Your specific subscription.
 

OPENING AN ACCOUNT

Following the download of the APP, You will be required to register an account for the APP using an existing account on Google, Facebook, or Apple. As part of the registration process, You will be asked to provide MKB with Your name, photo, email address, and IP address from the existing account You enrolled through; and as part of the operating and/or using process.
You will then be required to enter your full name, and your telephone number, and confirm Your consent to the provisions of these Terms. Thereafter, the APP will verify the phone number You provided by sending a unique code to Your mobile device, which You will be required to submit in order to complete the registration process. Please see our Privacy Policy  to see how we treat your personal information.
The purpose of obtaining the information is to enable MKB to communicate with you, to provide and/or offer the Service as well as to improve and optimize the Service to users and customers of MKB.
You undertake to provide MKB with correct, true and accurate information, as requested in the APP’s registration form, and not to enter any information of a third-party or any information that is incorrect and inaccurate. By creating an account, you represent and warrant to us that you are not a bot or other automated methods You must notify MKB of any change and/or update in the information provided to MKB with respect to the registration and opening of an account.
You may be asked to grant the App permission to access existing data on your smartphone when you register and fill out information, including your photo galleries, camera and location. The list of permissions required by the APP may change from time to time and is listed when You install or update the APP. You must grant these permissions to receive the Service offered in the APP. This information will be used only by the MKB and will not be sent to any third-party without Your consent ahead of time.
Notwithstanding anything to the contrary set forth in these Terms, when you sign up for the Service you warrant that you are (i) interested in, and (ii) consent to receiving push notifications from MKB and/or any entity on its behalf, and that MKB and/or any other company appointed thereby will send the information to any third-party at its sole discretion.
 

After you have opened an account, you will have the option to open a dedicated page for a person you are familiar with (men or women) who you know is seeking love or other kind of romantic relationship, for the purpose of introducing him/her to other persons who were also introduced by other users of the APP (the "Individual").
As part of introducing the Individual to other users of the APP, you will be required to provide details about this Individual, such as full name, current telephone number, age, marital status, country of residence, city of residence, physical measurements (height and etc.), field of work, studies, religion, basic values, photos, romantic orientation and preferences for a potential partner (gender, age range, height range, religion). In addition, there will be a place where you can further elaborate and describe that Individual in Your own words, and share your personal opinion on such person .
Opening pages dedicated to an Individual and submitting any details about such Individual must be made with the full and explicit consent of such Individual regarding the usage You will be doing with his/her details, with uploading such information to the public domain and concerning the accuracy of those details. You are hereby required not to open such a dedicated page for the Individual and or refrain from providing any details in the creation of the said page without that Individual's explicit and affirmative consent to the opening of the page and providing such information.
By operating the App and completing registration of you and an Individual, you represent and warrant to MKB that you have obtained all necessary approvals and consents from the Individual, as may be applicable to process his or her personal information within the App, and that you are acting on the Individual’s behalf as his or her proxy with respect to the usage you will be doing with the Individual’s personal information.
 

While using the APP, you will be able to contact other user(s) who have also shared information about an Individual who is a potential match, chat with these user(s) and share profiles in your feed. You will also be able to send an invitation to such Individuals, recommending him/her to engage with another person introduced by another user, which You think can lead to a possible relationship. In such a case, the APP will notify both Individuals about the potential match you envision.
You hereby agree and acknowledges that MKB and/or anyone acting on its behalf will not be liable in any way for the accuracy and/or completeness of the information uploaded to the APP by its users, and that MKB does not provide any warranty representation, undertaking, recommendation, opinion, or statement of any other kind with respect to the accuracy, completeness, truthfulness, or the non-infringement of any third party intellectual property of anu information uploaded by users. The information displayed in the APP is provided to the user on an "As is" basis.
MKB trusts its users by providing them a dedicated platform that enables them to openly communicate with each other and helps them find potential love to their close ones. This trust should not be confused as tolerance to any abusive or illegitimate content. The content shared by users is routinely scanned by MKB in order to verify that its platform provides a safe and secure environment for communication. Uploading or communicating content that is abusive, or includes content that is racist, hateful, illegal, humiliating, indecent, or otherwise offensive towards other users, or addresses individuals or racial, religious, gender based or sexually oriented groups in a derogatory way is strictly forbidden. Such content will be removed from MKB's platform, and may result in a temporary or a permanent suspension from the platform.  
 

INTELLECTUAL PROPERTY

PROHIBITED USES IN THE APP
The use of and/or access to the App by you and/or by anyone else on your behalf is and shall remain solely your responsibility. You may not use our App in any manner that: (1) breaches any of the Use of Terms; (2) breaches any applicable local, national or international law or regulation; (3) infringes our copyright, trademark, trade secret or other intellectual property rights, or of third parties, or violate the privacy, publicity or other personal rights of others; (4) is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect; (5) has the potential to, interfere with any other party's use or enjoyment of the App (or servers or networks connected to it).
 

CHANGES TO THE TERMS
These Terms of Use may be amended by us at any time and from time to time. It is our policy to publish any changes amendments to these Terms of Use on our App. Changes to these Terms of Use shall become binding and effective when they are published on our App. Your continued use of the App or its Services after the amended Terms of Use have entered into effect will constitute your acceptance of them.
